Welcome to AVERA. These Terms of Service ("Terms") govern your access to and use of the AVERA mobile application (the "App") and related services provided by Invictus Pro SRL("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Invictus Pro SRL.

2. Eligibility

To use the App, you must:

  • Be at least 13 years of age (or 16 in the European Economic Area)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the App under applicable laws
  • Provide accurate and complete registration information

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

AVERA is a mobile application that allows users to earn AVR tokens through simulated mining activities, completing tasks, and participating in referral programs. The App includes:

  • Mining Feature: Earn AVR tokens through timed mining sessions
  • Job System: Complete tasks to earn additional rewards and level up
  • Referral Program: Invite friends and earn bonuses when they reach milestones
  • Leaderboard: Compete with other users based on mining performance

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must create an account by providing a valid email address, username, and password. You agree to provide accurate, current, and complete information during registration.

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that we believe have been compromised.

4.3 One Account Per User

Each user is permitted only one account. Creating multiple accounts to gain unfair advantages or circumvent restrictions is strictly prohibited and may result in permanent suspension of all associated accounts.

5. AVR Tokens

5.1 Nature of Tokens

AVR tokens are virtual items within the App ecosystem. They are NOT:

  • Legal tender or currency
  • Securities or investment instruments
  • Guaranteed to have any monetary value
  • Redeemable for cash or cash equivalents unless explicitly stated

5.2 Token Earning

AVR tokens can be earned through mining activities, completing jobs, referral bonuses, and other promotional activities as determined by us. We reserve the right to modify token earning rates, mechanisms, and requirements at any time.

5.3 No Guarantee of Value

We make no representations or warranties regarding the current or future value of AVR tokens. Any potential future utility or exchange capability is not guaranteed and depends on various factors beyond our control.

6. User Conduct

You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Use bots, scripts, or automated tools to interact with the App
  • Exploit bugs, glitches, or vulnerabilities for unfair advantage
  • Engage in fraud, manipulation, or deceptive practices
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Sell, trade, or transfer your account to third parties
  • Use the App while operating vehicles or heavy machinery

7. Referral Program

7.1 Program Rules

The referral program allows you to earn rewards by inviting new users. Referral codes must be shared only with people you know personally. Mass distribution, spam, or fraudulent referral activities are prohibited.

7.2 Reward Conditions

Referral rewards are subject to verification and may be revoked if we determine that the referral was fraudulent or violated these Terms. We reserve the right to modify or discontinue the referral program at any time.

8. Advertising

The App displays advertisements from third-party advertising networks, including Google AdMob. By using the App, you acknowledge that:

  • Advertisements may be personalized based on your data
  • We are not responsible for the content of third-party advertisements
  • Clicking on advertisements is at your own risk
  • You may opt out of personalized ads through your device settings

9. Intellectual Property

9.1 Our Rights

The App, including its design, features, content, and technology, is owned by Invictus Pro SRL and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9.2 Restrictions

You may not:

  • Copy, modify, or distribute the App or its content
  • Use our trademarks, logos, or branding without permission
  • Create derivative works based on the App
  • Remove any copyright or proprietary notices

10. Disclaimers

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee of Availability

We do not guarantee that the App will be available at all times or that it will be free from errors, bugs, or interruptions. We may modify, suspend, or discontinue the App at any time without notice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVICTUS PRO SRL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to your account
  • Loss of data, tokens, or virtual items
  • Third-party content or advertisements
  • Any errors or omissions in the App

Our total liability shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Invictus Pro SRL and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

13. Termination

13.1 By You

You may terminate your account at any time by deleting your account through the App or contacting us at [email protected].

13.2 By Us

We may suspend or terminate your account immediately, without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the App or its features
  • Extended period of inactivity

13.3 Effect of Termination

Upon termination, your license to use the App ends immediately. Any accumulated AVR tokens or progress may be forfeited. Provisions that by their nature should survive termination will remain in effect.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the App or website. Your continued use of the App after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Romania.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Invictus Pro SRL regarding your use of the App and supersede any prior agreements.
